Client means the individual, business or organisation purchasing the Services.
Services means the supply, erection, hire, alteration and dismantling of scaffolding and access equipment, as agreed in writing.
Site means the location where the Services are to be provided.
Contract means the agreement between the Company and the Client for the provision of Services, incorporating these Terms and Conditions.
Equipment means all scaffolding materials, components, fittings and related items supplied by the Company.
2. Formation of Contract
A Contract is formed only when the Company issues a written quotation and the Client provides written acceptance.
All quotations are valid for thirty days unless stated otherwise.
These Terms and Conditions apply to all Contracts and override any other terms proposed by the Client.
3. Scope of Services
The Company will carry out the Services in accordance with the agreed quotation and in compliance with relevant UK legislation and industry standards including TG20 and SG4 guidance.
Any variation or additional works requested by the Client must be confirmed in writing and may result in additional charges.
The Company reserves the right to alter design, materials or methods if required for safety or compliance.
4. Client Responsibilities
The Client must ensure that the Site is suitable, safe and has adequate access for the Company’s vehicles, materials and personnel.
The Client must obtain all necessary permissions, permits, licences, pavement licences and traffic management approvals unless otherwise agreed in writing.
The Client is responsible for advising the Company of any hazards, underground services, overhead cables or restricted load areas prior to commencement.
The Client must ensure that no unauthorised alterations or additions are made to the Equipment.
The Client must always maintain clear access to the Equipment to allow for inspection, alteration and dismantling.
5. Hire Period
Hire commences from the date the Equipment is erected, handed over to the Client and confirmed as ready for use.
The minimum hire period is as stated in the quotation.
Additional hire charges will apply if the Equipment remains erected beyond the agreed period.
6. Charges and Payment
Prices are as stated in the accepted quotation.
Unless otherwise agreed, payment terms are fourteen days from the date of invoice.
The Company reserves the right to charge interest on overdue sums at 8 percent above the Bank of England base rate.
The Client may not withhold payment for any reason, including disputes or claims relating to third party contractors.
The Company may suspend or withdraw Services if the Client fails to meet payment obligations.
7. Equipment Ownership and Use
All Equipment always remains the property of the Company.
The Client must not move, modify, interfere with or permit the misuse of the Equipment.
The Client is responsible for the security of the Equipment while on Site and will be liable for any loss or damage caused by theft, vandalism or misuse.
8. Access for Inspections and Alterations
Inspections are not included within our quotation unless specifically stated. The Client is responsible for ensuring that statutory weekly scaffold inspections are carried out and recorded. RR Access Ltd offers a weekly scaffold inspection service if required.
The Company will carry out inspections in line with statutory requirements.
The Client must provide safe and unrestricted access for inspections, maintenance and modifications.
Requests for alterations must be made with reasonable notice and may incur additional charges.
9. Delays and Site Conditions
RR Access Ltd is not liable for any delays caused in the erection or dismantling of the scaffolding due to restricted access, site conditions, third party interference, adverse weather or factors beyond the Company’s control.
Where delays occur for reasons outside the Company’s control, additional charges may be applied to cover waiting time, labour costs, rescheduling or aborted visits.
All dates provided are estimates only and not guaranteed.
10. Health and Safety
The Company will operate in accordance with relevant UK health and safety legislation.
The Client must ensure that no other parties compromise the safety or integrity of the Equipment.
The Client is responsible for ensuring that loads placed on the scaffolding do not exceed safe working limits.
The Company reserves the right to halt work if Site conditions are unsafe.
11. Damage and Liability
RR Access Ltd is not liable for making good or repairing any tying-in holes or fixing points.
RR Access Ltd shall not be responsible for damage to roofs or roof features.
RR Access Ltd is not liable for marks, wear or damage where scaffolding bears against the building.
The Client is responsible for loss or damage to Equipment other than fair wear and tear.
The Company is not liable for consequential loss or business interruption.
Nothing limits liability for death or personal injury caused by negligence.
12. Insurance
The Company maintains appropriate public and employer’s liability insurance.
The Client must maintain adequate insurance covering risks arising from their activities.
13. Dismantling
The Client must provide a minimum of forty-eight hours’ notice for dismantling.
Hire charges apply until dismantling is completed.
14. Cancellation
Cancellation after acceptance may incur charges for materials and labour.
An aborted visit charge applies where access is unavailable.
15. Force Majeure
The Company is not liable for failure caused by events beyond its reasonable control.
16. Termination
The Company may terminate immediately for breach, insolvency or non-payment.
The Company may enter the Site to recover Equipment upon termination.
17. Governing Law
These Terms are governed by the laws of England and Wales.
Disputes are subject to the exclusive jurisdiction of English and Welsh courts.
18. Welfare Provisions
The Client must provide suitable welfare facilities in accordance with UK legislation.
Facilities must be available throughout the works.
The Company may suspend works where welfare is inadequate, with costs chargeable.
19. Communication
The Client must provide a designated point of contact.
All instructions and variations must be confirmed in writing.
The Client must notify RR Access Ltd of any changes affecting the works.
